Ramin Hossein Panahi's death sentence confirmed by the Supreme Court

Kurdish political prisoner Ramin Hosseinpanahi has been sentenced to death on charges of “insurrection,” meaning fighting against the Islamic State. His lawyer says Hosseinpanahi is innocent and should be pardoned.

Ramin Hossein Panahi, a member of the Komala party, has been sentenced to death on charges of “rebellion.” He was arrested in July of last year while sitting in a car with three others in a clash with security officers, and three of his companions were killed.

Hossein Ahmadiniaz, Hossein Panahi's lawyer, tells Deutsche Welle that his client was unconscious and injured when he was arrested and that he was not involved in the conflict at all.

Rebellion in Islamic jurisprudence means rebellion and uprising against the Islamic government. According to Article 287 of the Islamic Penal Code, a group that waged an armed uprising against the Islamic Republic of Iran is considered a rebel, and if weapons are used, its members are sentenced to death.

Ahmadiniaz says his client's trial process violates Article 34 of the Constitution of the Islamic Republic of Iran because his trial was not "fair and just" and the trial court was not independent.

The defense attorney says he will request a retrial for his client. According to him, so far, 80 lawyers and 31 members of the Islamic Consultative Assembly have requested a pardon for Ramin Hossein Panahi.

Ramin Hossein Panahi was arrested last July and spent 200 days in the Revolutionary Guards prison in Sanandaj. He was then transferred to the city's Intelligence Department prison and then to Sanandaj Central Prison.
