Third Court Session Scheduled for Trial of Amirhossein Moradi and Ali Younesi

Mostafa Nili, a lawyer, stated that the third court session to hear charges against Ali Younesi and Amirhossein Moradi, students at Sharif University of Technology, will be held on Sunday, April 18th at the Revolutionary Court. He also noted that unfortunately, despite legal provisions for converting temporary detention orders, no attention has been paid to the requests of our clients, and authorities told the families that regular wards are not suitable places, and they have kept these two detained students in Ward 209 for their own welfare.

According to Hrana news agency, citing Emtedad, Mostafa Nili, the lawyer for Ali Younesi and Amirhossein Moradi, Sharif University of Technology students and Olympiad participants, announced that the hearing on their case will take place next week.

The lawyer stated in this regard: “The next session to hear the case of Ali Younesi and Amirhossein Moradi, two detained students of Sharif University, which is the third hearing session, will be held on Sunday, April 18th. Unfortunately, despite legal provisions for converting temporary detention orders, given that more than two years have passed since their arrest, no attention has been paid, and the detention of Ali Younesi and Amirhossein Moradi continues illegally.”

Nili added: “Senior officials of the judicial system repeatedly invite judges and prosecutors in their speeches to minimize the use of temporary detention orders, but in this case we witness that even legal provisions are not being observed. Following our request last week from the head of the Revolutionary Court and the scheduling by him, yesterday on Monday, lawyers along with the families of these two young men visited the office of the head of the Revolutionary Court, which after two hours of waiting, we were told that the head of the Revolutionary Court would initially receive the families and then the lawyers.”

The lawyer continued: “The presence of the families was accompanied by a meeting lasting more than an hour with the head of the Revolutionary Court, but unfortunately no response was given to the legal request to convert the temporary detention order in that session. After the families left, we intended to raise our legal request, but the head of the court refused to meet with the lawyers in the case. The office director of the head of the Revolutionary Court, quoting him, said that I have no discussion with the lawyers and have raised all matters with the families.”

Mostafa Nili stated: “According to the families, another person besides the head of the Revolutionary Court was present in that session who initially treated the families badly and the session had an interrogation nature! The families said that when we objected to this treatment, they changed their tone of communication, but still no response was given to the original request, which was to convert the detention order of these two young men.”

According to him, unfortunately, this disregard for the law has continued, and given the quick scheduling of the hearing, it appears they have no intention of accepting this legal matter. When the families asked why these two young men were not sent to regular wards after two years and are still being held in security Ward 209, the response was that regular wards are not good places and for the sake of the boys’ welfare, they have kept them in Ward 209! In this case, investigators have emphasized that these two young men must be held in Ward 209 until a final verdict is issued, and unfortunately the judicial system has complied with this request, and in response to the constant protests of these two students, their families and lawyers, such justifications are being presented.”

Ali Younesi, a computer engineering student, and Amirhossein Moradi, a physics student at Sharif University of Technology, were arrested on April 12, 2020 by officers from the Ministry of Intelligence and transferred to the detention facility of this institution known as Ward 209 of Evin Prison. It is reported that the arrest of these students was carried out by plainclothes officers, without presenting a court order and accompanied by beatings.

Gholamhossein Esmaili, spokesman for Iran’s Judiciary, on May 6, 2020, accused these students of cooperating with the Mujahedin-e Khalq.

Shortly after, Aida Younesi, Ali Younesi’s sister, published a video on social media refuting these accusations and attributed the reason for raising them to her parents’ imprisonment record in the 1980s. In September 2020, Aida Younesi reported pressure on her brother to make televised confessions. In November 2020, Ali Younesi contracted coronavirus and sometime after recovery was returned to a multi-person cell.

Regarding these students, it is worth noting that Amirhossein Moradi is the winner of a silver medal in the National Astronomy Olympiad in 2017, and Ali Younesi is the winner of a silver medal in the National Astronomy Olympiad in 2016 and a gold medal in the Astronomy Olympiad in 2017. Also, Ali Younesi, by winning a gold medal at the twelfth International Olympiad on Astronomy and Astrophysics held in China, brought honor to Iran.
