Ramin Hosseinpanahi’s Death Sentence Upheld in Iran’s Supreme Court

Ramin Hosseinpanahi, a Kurdish political prisoner, has been sentenced to death on charges of “baghi” (waging war against the Islamic government). His lawyer says Hosseinpanahi is innocent and should be pardoned.

Ramin Hosseinpanahi, a member of the Komala party, has been sentenced to death on charges of “baghi.” He was arrested last June when he was in a vehicle with three others during a clash with security forces, and his three companions were killed.

Husein Ahmadi Niyaz, Hosseinpanahi’s lawyer, told Deutsche Welle that his client was unconscious and wounded at the time of arrest and had no involvement whatsoever in the clash.

Baghi in Islamic jurisprudence means rebellion and uprising against the Islamic government. According to Article 287 of Iran’s Islamic Penal Code, any group that stages an armed uprising against the Islamic Republic of Iran is considered “baghi,” and if weapons are used, its members are sentenced to death.

Ahmadi Niyaz says the trial process of his client violates Article 34 of Iran’s Islamic Republic Constitution, as his trial was neither “fair nor just” and the court was not independent.

This defense lawyer says he will request a retrial for his client. According to him, so far 80 lawyers and 31 members of various sessions of the Islamic Consultative Assembly have raised requests for Ramin Hosseinpanahi’s pardon and amnesty.

Ramin Hosseinpanahi was arrested last June and spent 200 days in prison at the Islamic Revolutionary Guards Corps detention facility in Sanandaj. He was later transferred to the Intelligence Office prison in the city and then to Sanandaj Central Prison.
