More than forty days after the execution; No access to Navid Afkari's case/ Increasing concern about the Afkari brothers' situation

Hassan Younesi, the lawyer for the Afkari brothers, announced that access to Navid Afkari's case has not been allowed despite the fact that 40 days have passed since his execution, and said, "According to the regulations for the execution of death sentences, the convict must be examined by a doctor before the sentence is carried out, and his latest physical condition must be recorded and recorded." Navid Afkari's family and the lawyers for the case continue to be concerned about the manner of execution and Navid's latest physical condition and health. They are ambiguous.” He also described the situation of Habib and Vahid Afkari as “worrying,” adding, “Since the execution of Navid Afkari’s sentence, Vahid and Habib have been held in a location outside the general ward, and during this time, their family and lawyers have not had any visits with the Afkari brothers, which is against the law.”

According to HRANA news agency, quoted by Emtaed, Hassan Younesi, the lawyer in the Afkari brothers' case, stated: "Based on the information provided by my lawyer colleagues who are based in Shiraz, Habib and Vahid Afkari are in a worrying situation."

He added: "Despite the follow-up and more than 40 days after Navid Afkari's execution, unfortunately, lawyers have not yet been granted access to his case file. According to the law, Navid's lawyers and family have the right to access the minutes of the execution of the sentence and its procedure."

Younesi stated: “According to the regulations for the execution of death sentences, the convict must be examined by a doctor before the sentence is carried out and his latest physical condition must be recorded. This issue must be recorded in addition to the details of the execution method, including the names of those present during the execution, when preparing the minutes. However, despite repeated requests, the lawyers have not been able to see the minutes and the final examination before the sentence is carried out. Therefore, Navid Afkari’s family and the lawyers in the case are still uncertain about the execution method and Navid’s latest physical condition and health.”

The lawyer added: “Before the execution, Navid Afkari, Vahid and Habib had reported the beating in their calls. They also stated that the effects of the beating had been recorded and recorded by the forensic medicine. Vahid and Habib Afkari have filed a complaint regarding this issue, and the judicial authorities and prison officials are obligated to investigate this complaint. It is necessary to provide lawyers with access to the forensic medicine report and legal meetings with these two clients so that they can take legal action to pursue their complaint regarding the beating.”

Younesi pointed out that since the execution of Navid Afkari's sentence, Vahid and Habib have been held in a place outside the general ward, and during this time, their family and lawyers have not had any (free) visits with the Afkari brothers. He added: "Therefore, there is no information about the condition of the place of detention and whether they are being held in solitary confinement or not. This is an issue that has caused concern for the Afkari family. According to the prison regulations, definitively convicted persons must only be held in general wards and under the supervision of the Prisons Organization. Also, according to the same regulations, the detention of defendants in detention will only be possible with a written order from the judicial authorities, and the detention of Habib and Vahid Afkari outside the general ward of the prison and without (free) visits is against the law."

He continued: "Even if this action was taken as a disciplinary punishment, keeping a prisoner in solitary confinement is not legal, and according to the regulations for keeping prisoners, keeping them in such conditions is both immoral and against these regulations."

It is worth noting that Navid and Vahid Afkari were arrested on September 16, 2018, and Habib Afkari on December 12, 2018, in connection with the nationwide protests of August 2018. These individuals have been repeatedly beaten and tortured during interrogations to extract confessions.

These citizens were tried by the Revolutionary Court and the Shiraz Criminal Court, and Navid Afkari was sentenced to two executions, 6 years and 6 months in prison, and 74 lashes, Vahid Afkari to 54 years and 6 months in prison, and 74 lashes, and Habib Afkari to 27 years and 3 months in prison, and 74 lashes.

Navid Afkari's death sentence was finally carried out at dawn on Saturday, September 12, 2020, in Adel Abad Prison in Shiraz.
