Where in Islamic Law Does It State That Christian, Jewish, or Zoroastrian Women Must Wear Hijab?

Morteza Alviri, regarding the hijab law, stated: “Where in Islamic law does it say that Christian, Jewish, or Zoroastrian women must wear hijab?”

Morteza Alviri, a member of the Islamic Consultative Assembly, regarding the hijab law and Islamic standards, said: “According to the Chastity and Hijab Law, if an elderly woman walks through the city without hijab, she must be fined and even imprisoned. This is precisely contrary to the explicit view of the sources of emulation who have stated that elderly women do not need to observe hijab. Therefore, this law is un-Islamic, meaning it is inconsistent with Islamic standards.

In my view, this Chastity and Hijab Law is un-Islamic, inhumane, immoral, and economically harmful. Of course, I am listing these points with full awareness and will explain them. First, this law is un-Islamic because in Islam, there is no punishment for anyone who does not observe Islamic hijab. This is not found in the Quran, nor in the Prophet’s tradition, nor in the tradition of the Imams.”

He also added, referring to the severe financial penalties regarding non-compliance with hijab: “Imposing heavy financial penalties and imprisonment for someone who does not observe Islamic hijab contradicts Islamic standards, the Quran, and the Sunnah. Moreover, there are other explicit points in this regard that demonstrate this contradiction even more. The very scholars who believe in Islamic hijab agree that religious minorities do not need to observe Islamic hijab, and the same scholars agree that elderly women do not need to observe Islamic hijab, yet in this law that was passed in parliament, a Christian, Jewish, or Zoroastrian woman must wear hijab. Where in Islamic law is this mentioned? This is precisely contrary to the Islamic standards that scholars unanimously agree upon.”
