Process of Referring PS752 Flight Downing Case to International Court of Justice in The Hague Begins

Hamed Esmailioun released a video in which he discusses the beginning of the process to refer the case of the downing of Flight PS752 to the International Court of Justice in The Hague.

In this video, he states: “Today, four countries—Canada, Ukraine, Britain, and Sweden—issued an important diplomatic warning to the Islamic Republic. This diplomatic note indicates the criminal responsibility of the Islamic Republic based on the 1971 Montreal Convention. A convention that encompasses international aviation safety. This note holds the Islamic Republic responsible for the intentional shooting down of the flight and is directed at all those who played a role in the downing of Flight PS752. The Islamic Republic has six months to respond to this warning, and at the end of this six-month period, which cannot be extended, the four states can formally refer the case to the International Court of Justice in The Hague. The path that the families’ association has traveled to reach this important and fundamental point in achieving justice has been filled with legal and political complexities. No one believed it was possible to traverse this path, but we were hopeful for a glimmer of justice and the power of organization. Today is one of those days we were waiting for. The Islamic Republic will be called to the International Court of Justice to fully reveal the truth and be held accountable.

We thank the four affected states for assisting us in reaching this day. We thank them for engaging Dr. Payam Akhavan, former UN prosecutor, and we ask that they continue to utilize his knowledge and understanding of the corrupt government of the Islamic Republic and his valuable experience in other international cases to present the case to the Court in The Hague at the end of the designated six-month period.”

Hamed Esmailioun dedicated the arrival of this day on behalf of the families to the children of the victims.

This case, as the first case of crimes by the Islamic Republic, will go to The Hague Court seeking justice for 176 innocent lives lost and unborn children.
